Biography Andy’s practice focuses on patent litigation and counseling, including representation of clients in technological areas such as self-expanding braided nitinol medical devices, telecommunications cables and routers, optical films, two-dimensional data encoding, and cardiac rhythm management (“CRM”). His experience includes Markman and summary judgment strategy and brief-writing. He has also worked closely with expert witnesses to develop infringement and invalidity positions. With broad discovery experience from the pre-suit stages of a case up through expert discovery, Andy has developed and managed written discovery, developed document production and review strategies, argued non-dispositive motions, and taken numerous depositions. Andy also developed and educated European attorneys on a complex patent enforcement strategy for a client with global presence.
Prior to joining CCVL, Andy served as an extern to then-Chief Judge James M. Rosenbaum in the District Court for the Federal District of Minnesota.
Before law school, Andy worked as a computer design engineer, designing and developing computer chips for a global corporation. Andy has also worked in the computer memory industry and performed research in the areas of integrated circuit micro-fabrication and micro-electromechanical systems.
Andy is active in the legal community and regularly works on pro bono matters. He particularly enjoys representing foster care children on behalf of the Children’s Law Center.
Recent cases include:
- Regents of the University of Minnesota v. AGA Medical Corp., No. 07-CV-4732 (D. Minn.) Andy represents AGA Medical in a patent infringement suit filed against AGA by the University of Minnesota, who allege infringement by AGA’s self-expanding braided nitinol mesh occluders.
- Kemin Foods v. Omniactive Health Technologies, No. 8:07-cv-1308 (M.D. Fla.) Andy conducted discovery as part of a litigation team that represented defendant Omniactive in a suit alleging patent infringement by Omniactive’s lutein drug supplements.
- Patect v. Veritec and VCode Holdings, No. 5:10-cv-00091 (E.D. Tex.) Andy represents defendants Veritec and VCode in the Eastern District of Texas against false marking claims brought by the plaintiff.
- Khan v. Mukasey, No. 07-3908 (8th Cir. 2008) (Pro Bono) Andy and another associate secured a remand from the Eighth Circuit on the denial of their client’s petition for asylum or withholding of removal.
