Biography
Sam concentrates his practice on intellectual property litigation, primarily focusing on pharmaceutical patent cases. He routinely defends drug companies that are seeking FDA approval to commercialize and market bioequivalent drug products against patent infringement lawsuits brought under the Hatch-Waxman Act. Sam also has represented clients in patent disputes involving other areas of technology, including biomedical device, software, and telecommunications. In addition, Sam has represented clients in trademark disputes in both federal court and before the Trademark Trial and Appeal Board.

Sam is active in the legal community and regularly works on pro bono matters. He particularly enjoys representing foster care children on behalf of the Children’s Law Center.

In 2008, 2009 and 2010 Sam was named a “Rising Star” by Minnesota Law & Politics magazine.

Recent cases include:
  • Pozen Inc. v. Teva Pharmaceuticals USA, Inc., Civil Action No. 6:09-CV-182 (E.D. Tex.), involving the patents that purportedly cover Glaxosmithkline’s naproxen/sumatriptan drug product (brand name Treximet®)
  • Takeda Pharmaceutical Company et al. v. Watson Pharmaceuticals, Inc. et al., Civil Action No. 09-917 (Dist. Del.), involving the patent that purportedly covers Takeda’s ramelteon drug product (brand name Rozerem®)
  • Celgene Corporation et al. v. Teva Pharmaceuticals USA, Inc., Civil Action No. 07-CV-4459 (Dist. NJ), involving five patents that purportedly cover Novartis’ extended release dexmethylphenidate drug product (brand name Focalin XR®)
  • Elan Corporation v. Teva Pharmaceuticals USA, Inc., Civil Action No. 07-552 (Dist. Del), involving two patents that purportedly cover Elan’s SODAS® technology used in connection with Focalin XR® and other pharmaceutical drug products
  • Celgene Corporation et al. v. Teva Pharmaceuticals USA, Inc., Civil Action Nos. 04-4030 & 06-6154 (Dist. NJ), involving two patents that purportedly cover Novartis’ dexmethylphenidate drug product (brand name Focalin®)
  • Altana et al. v. Teva Pharmaceuticals USA, Inc., Civil Action No. 04-2355 (Dist. NJ), involving the patent that purportedly covers Wyeth’s pantoprazole drug product (brand name Protonix®)
