Biography Todd practices complex commercial litigation, with a focus in the areas of patent, trade secret, and trademark litigation. Leveraging his biochemistry background, Todd has extensive experience representing generic pharmaceutical companies challenging the patent rights of their competitors through ANDA litigation. Todd has litigated patent infringement disputes in a variety of other disciplines as well, including the electrical and mechanical arts. In 2007, 2008 and 2009 Minnesota Law & Politics magazine named Todd a "Rising Star" in the area of patent litigation.
Representative cases include:
- Sepracor, Inc. v. Teva Pharmaceuticals USA, Inc., et al.: litigation involving four patents directed to eszopiclone (Lunesta®)
- Altana Pharma AG v. Teva Pharmaceuticals USA, Inc., et al.: litigation involving challenge of patent directed to pantoprazole (Prilosec®)
- MTS Systems Corp. v. Hysitron, Inc.: litigation concerning patent directed to nanomechanical measuring devices
- Ecolab, Inc. v. FMC Corp.: litigation involving patents covering antimicrobial compositions for use on meat and poultry
- Elan Corp. v. Teva Pharmaceuticals USA, Inc., et al.: litigation concerning patent covering the formulations of Novartis’s ADDERALL XR® and FOCALIN XR® products
- Celgene Corp. v. Teva Pharmaceuticals USA, Inc., et al.: litigation concerning patents covering the active ingredient and formulations of Novartis’s ADDERALL XR® and FOCALIN XR® products
Todd currently teaches Intellectual Property Moot Court at the University of Minnesota Law School. He also represents indigent clients in federal court through the Federal Bar Association Pro Se Project.
